Mandatory inspections of construction machinery: legal basis

Excavators, wheel loaders, tracked machines and dumpers are found on almost every site - and all of them are subject to statutory inspection requirements. Inspecting construction machinery is not a voluntary service but a binding requirement under Government Regulation No. 392/2006 Coll. (work equipment) and occupational safety rules (Act No. 124/2006 Coll.). Anyone who neglects deadlines or documentation may be held liable - including for damage to third parties.

The obligation to inspect construction machinery arises from Government Regulation No. 392/2006 Coll. (work equipment) in conjunction with Act No. 124/2006 Coll. on occupational safety and health. For technical equipment, inspections and tests of technical equipment apply (Decree No. 508/2009 Coll.). Basis:

  • Government Regulation No. 392/2006 Coll.: operators must keep work equipment in proper condition and have it inspected regularly for safe operation
  • Occupational safety rules (depending on machine type): specify the inspection scope and the inspector's qualification
  • STN EN standards and manufacturer requirements supplement the statutory minimum requirements

Which machines are affected?

The inspection obligation applies to all self-propelled and non-self-propelled construction machinery used commercially - regardless of year of manufacture, engine output or frequency of use:

  • Excavators (crawler excavators, wheeled excavators)
  • Wheel loaders and compact loaders
  • Rollers (soil, asphalt, combination rollers)
  • Tracked vehicles and dozers
  • Dumpers and dump trucks
  • Mobile excavators and hydraulic excavators
  • Compaction equipment (vibratory plates, rammers - depending on classification)

Not every machine is subject to the same requirements - for special machines and borderline classifications, consult the labour inspectorate or a safety specialist.

Inspection deadlines for construction machinery

Inspection deadlines result from applicable Slovak safety rules and manufacturer instructions. Shorter intervals are needed if:

  • the risk assessment identifies particular risks
  • the manufacturer recommends shorter deadlines
  • use is intensive (multi-shift operation, harsh environments)
  • a special inspection is ordered after a defect or accident

Inspection scope and procedure

Visual inspection

External inspection of the entire work equipment without operating the machine: frame for cracks and deformation, access safeguards, protective devices, markings and inspection stickers, visible leaks, condition of tyres or tracks.

Function test

Testing of all safety-relevant functions in operation: brake and steering system, lifting equipment, quick couplers (attachments), warning signals, lighting, safety interlocks, cab and seat belt, overload protection on hoists.

Documentation

All findings, defects and measures are recorded in writing in the inspection report. The report must contain at least the following: machine identification, inspection date and inspector, items inspected as a checklist, description of defects and measures, sticker number and next inspection date. The record is kept until the next inspection; in practice, a documentation folder that accompanies the machine is recommended.

Who may inspect construction machinery?

The inspection must be carried out by a person with the required competence in line with applicable Slovak safety rules. This requires:

  • Relevant vocational training (e.g. mechatronics technician, agricultural and construction machinery mechanic)
  • Professional experience with the machine class to be inspected
  • Recent professional activity with these machines

Cost guide by machine class

Inspection costs for construction machinery vary widely by machine class, inspection effort and inspector. Indicative ranges from the market:

  • Compact construction machinery (mini excavators, vibratory plates): approx. €80-150 per inspection
  • Wheel loaders, medium-sized excavators (up to 20 t): approx. €150-280 per inspection
  • Heavy construction machinery (>20 t, large excavators, rollers): approx. €250-500 per inspection
  • Special machines (milling machines, tunnel boring machines): on request

Is inspection of construction machinery mandatory?

Yes. Government Regulation No. 392/2006 Coll. obliges all operators of commercially used work equipment to carry out regular inspections - construction machinery is expressly included. Violations can lead to fines, operating bans and, in the event of damage, personal liability.

How often must excavators and wheel loaders be inspected?

At the intervals set by applicable Slovak safety rules and manufacturer instructions. With particularly intensive use, increased hazards or specific manufacturer instructions, shorter intervals may be required. The operator's risk assessment is decisive.

Who may inspect construction machinery?

A person with the required competence in line with applicable Slovak safety rules - with relevant training (e.g. construction machinery mechanic), proven professional experience and recent activity in the field. What must an inspection report for construction machinery contain?
