Which driving licence do you need for a telehandler?

Short answer: two questions, two answers

These are two different things that are regularly mixed up.

For driving on public roads, a driving licence under Act No. 8/2009 Coll. on road traffic is required — which category depends on the design speed and weight of the machine.

For operating on site, no driving licence is needed, but the required operator competence and written authorisation by the employer.

Anyone who mixes the two up will reach the wrong conclusions. This guide keeps them clearly apart.

Driving licence for the road: which category?

Under road traffic law, telehandlers are classed as self-propelled working machines. The required category depends on the design speed and the maximum permissible total weight:

On a closed-off company site, no driving licence is required — only occupational safety rules apply there, with operator competence, authorisation and minimum age.

Special case: 40 km/h telehandlers

Fast machines with a design speed of 40 km/h are popular because they can drive between sites themselves. This is exactly where the most common misjudgement lies: since practically every telehandler weighs well over 3.5 tonnes, a category B licence is not enough. Outside agricultural and forestry use, category C1 or C is required. Registration and insurance obligations also apply.

Authorisation to operate on site: operator competence

Regardless of any driving licence, occupational safety rules require the required operator competence for rough-terrain telehandlers in line with applicable Slovak safety rules. A distinction is made by type of use:

  • Fixed telehandlers in their basic function (lifting, stacking, transporting)
  • Roto telehandlers and use with a winch or load hook as a crane replacement
  • Transporting people in a work basket — here the rules for work at height under Government Regulation No. 147/2013 Coll. also apply

Operator competence is provided exclusively by external recognised training providers: educational institutions, testing organisations and manufacturer academies. What applies when renting?

The same legal situation applies to every rental machine as to your own machines: the operator needs the required operator competence and authorisation from their employer.

Registration, number plates and insurance

The driving licence is only half the answer — the vehicle itself must also comply with road traffic law.

Self-propelled working machines with a low design speed may be exempt from registration under certain conditions; even then, however, they need liability insurance. The details are set by Slovak rules.

At higher design speeds, registration is mandatory: number plate, approval or EC type approval, technical inspection and compulsory motor liability insurance. This is exactly what affects the popular 40 km/h machines.

Attachments change the legal situation. A bucket or fork mounted at the front can change dimensions, axle loads and visibility so that driving on a public road is only permitted with a cover, a protective device or not at all. If in doubt, the attachment is transported separately.

Minimum age, fitness and written authorisation

For operating on site, three things must come together, and all three are the employer's responsibility:

  1. Minimum age 18. Young people may only operate telehandlers as part of vocational training and under supervision.
  2. Physical and mental fitness. Eyesight, reaction ability and state of health must suit the task; whether and which occupational health care is offered or required follows from the risk assessment.
  3. Written authorisation. It names the person, the machine type and the area of use. Without it, operating is not allowed even with valid proof of competence — this point is regularly checked first during inspections and after accidents.

Four misjudgements from practice

"With category B I can drive anything up to 3.5 tonnes." Correct — but hardly any telehandler weighs less than 3.5 tonnes. Even compact machines are above that.

"On the construction site the road is private, so nothing applies." Public traffic space is any area that is actually generally accessible — including the unfenced site access. Only effective closure turns it into non-public ground.

"An agricultural licence covers everything." It applies to agricultural and forestry purposes. Commercial construction traffic is not covered, even if the same machine is driven.

"The forklift operator licence is enough." It applies to forklifts. Telehandlers require their own telehandler operator competence.

Special cases: temporary agency work, subcontractors and foreign driving licences

Agency workers. The agency provides the operator competence, while the authorisation and briefing on the specific machine are owed by the user company — i.e. the business where the work is done. This split is regularly overlooked and becomes apparent after a damage incident at the latest.

Subcontractors on your own site. Anyone who rents a machine and leaves it to a subcontractor remains responsible for the selection: it must be checked and documented that the subcontractor's operators are competent and authorised. A verbal assurance is not sufficient.

Foreign driving licences. EU and EEA driving licences remain valid in Slovakia within their categories. This does not apply so generally to operator competence under occupational safety rules: certificates from other countries must correspond in content to Slovak requirements; if in doubt, the business requires additional qualification from a recognised provider in Slovakia.

Apprentices and interns. Under the age of 18, operation is only permitted as part of vocational training, for training purposes and under the supervision of a competent person.

The same principle applies in all four cases: the machine may be rented, but responsibility for the person at the controls never is.
